These terms of Service (“Terms”) are a legally binding agreement between you and Set & Stones, LLC. By clicking “I Agree,” creating an account, or completing a purchase, you agree to these Terms and our Privacy Policy, including the binding arbitration agreement and class action waiver in Section 13, which means disputes are resolved individually rather than through class action lawsuits. You have 30 days from the acceptance to opt out of arbitration as described in Section 13(G). If you do not agree to these Terms, please do not use our Website. 

1. Welcome to Set & Stones

Thank you for visiting Set & Stones. These Terms govern your use of our website at www.setandstones.com and your relationship with us as a customer. We have tried to write them in plain language so they are easy to understand, but they are still a legally binding agreement, so please take a moment to read them.

We may update these Terms from time to time. When we make changes that matter, we will let you know by posting a notice on our Website or sending you an email at least 7 days before the changes take effect. If you continue using our Website after that date, we will take that as your acceptance of the updated Terms.

2. Who Can Shop With Us

Our Website is intended for customers who are 18 years of age or older. By using our Website, you confirm that you are at least 18. We love that you are interested in our jewelry, but if you are under 18 please ask a parent or guardian to shop on your behalf.

Please note that Set & Stones reserves the right, in its sole discretion, to refuse service, terminate accounts, remove or edit content, or cancel orders at any time and for any reason.

4. Shopping With Us

Our Products

We put a lot of care into how we present our jewelry on our Website. We do our best to accurately display colors, materials, and details, but please keep in mind that every screen is a little different, so what you see may vary slightly from the actual piece. All products are subject to availability, and we reserve the right to discontinue any item at any time.

While most of our jewelry is designed specifically for Set & Stones, some pieces are made by trusted third-party makers. These products may include the maker's name or mark. We carefully select every third-party product we carry.

Pricing

All prices are in U.S. dollars. We work hard to keep our pricing accurate, but occasionally errors happen. If we catch a pricing mistake on your order, we will reach out right away and give you the option to proceed at the correct price or cancel your order. Prices do not include applicable taxes or shipping, which will be shown at checkout.

Your Order

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order, for example, if an item is out of stock or if there is a pricing error. Your order is confirmed when you receive an order confirmation email from us.

Shipping and Delivery

We will arrange shipment of your order to you. Shipping charges are shown during checkout. Please note that shipping dates are estimates, we do our best but cannot guarantee exact delivery dates, and we are not responsible for carrier delays.

We want you to love your purchase. Please review our Return Policy before completing your order.

We use trusted third-party payment processors to handle your payment information securely. We never see or store your card number, CVV, or other financial credentials, that information goes directly to our payment processor.

• You have the right to opt out of having your data shared for advertising purposes at any time. Just click the Do Not Sell or Share My Personal Information link in our footer.

• You can also manage your cookie preferences at any time using the Cookie Settings link in our footer.

Browsing our Website does not automatically consent you to advertising tracking. We ask for your consent through our cookie banner first.

7. Staying in Touch

Order Updates

When you place an order, we will send you transactional emails about your order status, shipping, and delivery. These are necessary to fulfill your order and are not marketing emails.

SMS and Email Marketing

We would love to keep you in the loop about new collections, promotions, and special offers, but only if you want to hear from us. We will only send you marketing texts or emails if you have specifically signed up to receive them.

You can opt out of marketing texts at any time by replying STOP. You can unsubscribe from marketing emails using the unsubscribe link in any email we send. Opting out of marketing does not affect your order confirmations or other transactional messages.

8. Our Content and Your License to Use It

Everything you see on our Website, our photos, designs, text, logos, and product images, belongs to Set & Stones or our licensed partners and is protected by copyright and trademark law. We are glad you love our aesthetic, but please do not copy, reproduce, or use our content without our permission.

We give you a limited, personal license to browse our Website and use it for shopping purposes. That license does not include scraping our site, copying our content for commercial use, or using automated tools to access our Website.

9. Your Reviews and Submissions

We love hearing from our customers and we appreciate when you share reviews and photos of your jewelry. When you post a review or submit a photo to our Website, you give us permission to use it in connection with our business, including on our Website and in our marketing. We will never sell your submission to a third party.

When you share a review, we ask that you share your honest firsthand experience. Please keep reviews respectful and free from offensive language or discriminatory content. We reserve the right to remove any submission that does not meet these standards.

11. Giveaways and Promotions

We love celebrating our community with giveaways from time to time. Each promotion will have its own specific rules posted at the time. Here are the general rules that apply to all our giveaways:

• Giveaways are open to customers who are 18 years of age or older.

• No purchase is necessary to enter or win.

• Winners are chosen randomly and will be notified by email within 7 business days of the giveaway closing.

• If a winner does not respond within 72 hours, we may select an alternate winner.

• Prizes cannot be transferred or exchanged for cash.

• By winning, you agree to let us use your name and likeness for promotional purposes.

• Winners are responsible for any applicable taxes on prizes received.

12. Our Liability to You

OUR WEBSITE AND EVERYTHING ON IT IS PROVIDED “AS IS.” WE DO OUR BEST TO KEEP THINGS ACCURATE AND UP TO DATE, BUT WE CANNOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE ERROR-FREE OR UNINTERRUPTED. 

Nothing here limits any rights you have under California consumer protection law or any other law that does not permit these kinds of disclaimers.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SET & STONES IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR WEBSITE. OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE YOUR CLAIM OR $100. 

These limits do not apply to claims arising under California consumer protection statutes, the California Invasion of Privacy Act, federal privacy laws, or any other law that does not permit liability limitations of this kind.

13. Resolving Disputes

Let's Talk First

If something goes wrong, we would always prefer to resolve it directly. Before starting any formal process, please reach out to us at orders@setandstones.com and describe what happened. We will do our best to make it right within 30 days.

Binding Arbitration

If we are not able to resolve your concern informally, any dispute between you and Set & Stones will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, available at adr.org. The Federal Arbitration Act governs this agreement to arbitrate.

Fees and Location

Arbitration can be conducted by phone, video, or written submissions, or in person in San Diego, California if needed. Fees are allocated under the AAA Consumer Arbitration Rules.

Class Action Waiver

YOU AND SET & STONES AGREE TO RESOLVE ANY DISPUTES INDIVIDUALLY. YOU ARE WAIVING YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS ARBITRATION. IF THIS WAIVER IS FOUND UNENFORCEABLE AS TO A PARTICULAR CLAIM, THAT CLAIM WILL GO TO COURT INDIVIDUALLY, NOT AS A CLASS ACTION. 

This class action waiver stands on its own and remains in effect even if the arbitration agreement is found unenforceable for any reason.

Public Injunctive Relief

Nothing in these Terms takes away your right to seek a court order that protects the general public. Claims for public injunctive relief may be brought in court and are not subject to arbitration.

Small Claims Court

Either of us can bring a qualifying individual claim in small claims court at any time.

Your Right to Opt Out

If you would prefer not to be bound by the arbitration agreement, you can opt out by emailing orders@setandstones.com with the subject line "Arbitration Opt-Out" within 30 days of first agreeing to these Terms. Please include your name and email address. Opting out does not affect anything else in these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California. Any disputes that are not subject to arbitration will be resolved in the state or federal courts of San Diego County, California. If you have a complaint that we have not been able to resolve, you may also contact the Complaint Assistance Unit of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834 or by calling (800) 952-5210.

15. Data Breach Notification

If there is ever a security incident involving your personal information, we will notify you as required by California law, including California Civil Code sections 1798.29 and 1798.82.

16. Indemnification

You agree to defend and hold Set & Stones harmless from any claims, losses, or expenses, including attorneys' fees, that arise from your use of our Website, your violation of these Terms, or any content you submit to our Website.

17. A Few More Things

Entire Agreement

These Terms, together with our Privacy Policy, are the complete agreement between you and Set & Stones about your use of our Website.

Severability

If any part of these Terms is found to be unenforceable, the rest of the Terms remain in full effect.

No Waiver

If we do not enforce a particular provision of these Terms, that does not mean we are giving it up.

Assignment

You may not transfer your rights under these Terms without our permission. We may transfer ours at any time.
